1. *PHYSICAL CONDITION OF RENTAL ITEM(S)*
You acknowledge that before taking possession of the rented item(s), you examined it, observed its operation (if applicable), and are aware of its condition. The item(s) are in good condition, except for any defects noted on this contract. It’s your responsibility to return the rented items to Florida portable AC in the same condition, except for ordinary wear and tear. You agree to pay for any labor and/or parts required to repair any damage the equipment may have incurred during this agreement. If the repair costs exceed the replacement cost of the unit(s), you agree to pay the list price of the damaged unit(s) within 10 days of the damage.
2. *USE OF THE ITEM(S)*
You confirm that you are familiar with the use of the product and have informed Florida portable AC that no instructions were required. You further agree that the item(s) will only be used at the designated address and for its intended purpose. Unauthorized leasing or improper use is prohibited.
3. *RESPONSIBILITY FOR USE AND DISCLAIMER OF WARRANTIES*
You are responsible for the rented item(s) and assume all inherent risks. You agree to indemnify and hold Florida portable AC harmless from any claims for damage or injury resulting from the use, operation, or possession of the item(s), regardless of fault. No warranties, expressed or implied, have been made in connection with the rented equipment.
4. *RESPONSIBILITY FOR EQUIPMENT*
From the time the item(s) is rented until it is returned, you are responsible. If the item(s) is lost, stolen, or damaged while rented, you’re responsible for all charges, including repair costs. If the item(s) is returned unclean, a cleaning charge will be imposed. Failure to return the rented property as per this contract may lead to criminal prosecution.
5. *ITEM(S) FAILURE*
You agree to immediately stop using the rented item(s) if it becomes unsafe or in disrepair, and to notify Florida portable AC promptly. Florida portable AC may choose to repair the item(s), provide a similar item, or make one available at its discretion. This provision does not exempt you from other obligations outlined in other paragraphs.
6. *RETURN OF ITEM(S)*
The rented item(s) is owned by Florida portable AC and is subject to this rental contract. If you want to extend the rental period, you must notify Florida portable AC for approval. If you fail to return the item(s) on time, Florida portable AC can retake it at any time. You acknowledge the prohibition of not returning the item(s) on time and the potential consequences.
7. *CHARGES AND PAYMENTS*
You are responsible for rental charges from the specified start date until return, along with other charges. Return the item(s) promptly, clean, and in good condition. You and any representatives are responsible for all charges. Charges are due upon return unless prior arrangements have been made.
8. *COLLECTION COSTS*
You agree to pay attorney fees, collection fees, court costs, and other expenses related to collecting charges or enforcing this contract. Interest will be charged at a rate of 18% per annum on the outstanding rental sum.
9. *MODIFICATION OF CONTRACT*
This document constitutes the entire contract. No changes can be made to Florida Portable AC Conditioning’s rights or the contract’s term without written consent.
